Terms and Conditions

This agreement applies to your purchases of product(s) from this website. The parties to this agreement are: (1) the person who makes the purchase, referred to throughout the agreement as “you” or “your”, (2) our company, Modified Performance Ltd, whose registered address is 30 Barton Road, Badersfield, Norfolk, NR10 5JR, and companies house number is 14906238, Modified Performance Ltd is referred to in this agreement as the “company”, “we”, and “us”, and (3) our supplier who will be referred to throughout the agreement as “supplier”

We may make changes to the terms and conditions of this agreement, but the latest version will always appear on this page. Any changes to this agreement will apply to all new orders placed after the change is published on the website. You should check this agreement before each order you place, in case it has changed since your last visit.

By using the website (even if you don’t buy any goods) you also agree to be bound by the website terms of use. In the event of a conflict between this agreement and the website terms of use, this agreement will prevail.

In this agreement, the following capitalised words have these specific meanings.

‘Product’ means an item available for sale on the website.

‘Website’ meaning the Modified Performance Ltd website.

Orders of product(s) are subject to availability. When you place an order, we will confirm it by email, but the order will only become legally binding on us when we send you an email confirming dispatch of the product(s). If we cannot fulfil your order for any reason, we will notify you as soon as we reasonably can.

Modified Performance Ltd is a drop-shipping company and we are bound by our suppliers terms and conditions. As a drop shipping company we don’t carry stock and products are dispatched from our supplier. We are therefore unable to specify exact delivery times on parts as it is down to the supplier, their stock, and the availability of the product. If a product is out of stock the order will be placed and put on back-order until the part is available, at which point it will be dispatched to you, the customer.

 

Products and Orders

We try to ensure that product details displayed on the website are correct and up-to-date. However, any error or omission in any information on the website, or in any other communication or document issued by us, may be corrected without any liability on our part. You will then be given the option of re-confirming your order at the correct price or cancelling your order. If you have already paid for the product(s) at the incorrect price, you will receive a full refund if you decide to cancel.

Images of products on the website are intended as a guide and the actual product may differ slightly in some respects. All weights and dimensions given are approximate.

Before clicking the ‘Confirm Order’ button, you should check that your order summary is correct. You should print or retain your email confirmation in case you need to contact us about your order.

Unless otherwise stated, all prices shown on the website are inclusive of VAT and other applicable UK taxes. The prices shown do not include the delivery fee, which will be added at checkout.

 

Payments

Orders must be paid for immediately by credit or debit card. If we cannot accept your order for any reason, we will process a full refund within seven days.

All orders are positively credit card sanctioned prior to dispatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given.

We can only accept payment in pounds Sterling. We accept Visa Debit, Visa Credit, Mastercard and American Express, and all prices are inclusive of VAT.

 

Delivery

Our supplier will endeavour to deliver the product(s) as soon as possible after confirmation of your order. However, we cannot accept responsibility for loss or damage caused by any delay in delivering the product(s). We will try to keep you informed in the event of any delay from our suppliers, and the couriers.

As a drop shipping company we do not carry stock, so delivery times can vary depending on the product(s) stock from our supplier. If the ordered product(s) are in stock, products will usually be dispatched the next day. If not, the supplier will have to order from the manufacturer which will extend the delivery time. On products not in stock, our estimated delivery time is 5-15 working days. This time period can become extended past this time, sometimes in excess of 30 days. If the product(s) need to be ordered from the manufacturer, and the delivery time will surpass 30 days, we will endeavour to keep you updated throughout the process, and we will not be liable for any delays on orders.

Delivery will be to the address specified by you when ordering. Modified Performance Ltd only deliver to addresses in the United Kingdom.

As soon as the product(s) are delivered to you, you become the owner of those product(s) and the risk will pass to you. This means that you will be liable for any subsequent damage, loss or destruction to the Product(s).

Please note that we are unable to influence the delivery of any parcels once they have left the warehouse. Please ensure you have entered the correct delivery details prior to confirming your order. If we are unable to deliver due to wrong information being input at the order stage you will still be charged for all original and additional redelivery costs.

Should you feel that your order has become lost or was unable to be delivered to you please contact us after 5 days. Please note that we will try our best to resolve this issue but we may feel it is appropriate to refund your order after a second delivery attempt.

 

Back Orders

If a part on order is not in stock it is most likely “Backordered”. Backorder parts will hold up your order from shipping unless you advise us how to handle your order.

(Orders naturally ship when the full order is complete and then the computer system will release the order)

We will endeavour to always update you on any backordered parts which you have on order with us and will try to get an ETA for you.  Delays are expected at the moment and sometimes it is difficult to get ETA dates from our suppliers. However, we do have a system to check on our backordered items regularly so the orders will never be forgotten about.

 

Order Cancellations

Under the United Kingdom's Distance Selling Regulations you have the right to cancel your order for any item purchased from Modified Performance Ltd, based on our suppliers terms and conditions.

Order cancellations must be made via email as soon as possible to avoid shipping, quoting your order number, and should be done as soon as possible. However, if the order has been processed then you will need to contact us to get it shipped back to our supplier. Please read the returns and refunds policy as well.

We are bound by our suppliers terms and conditions as follows:

Our supplier offers a 14 day returns and refund policy from the date of delivery in accordance to the DSR. You will receive the full refund to the value of the order (delivery costs not included).

The parcel must be returned in brand new condition, unopened and in the original packaging. The customer must bare the delivery cost of the return of the product/order to our supplier.

This applies to all orders with us and our suppliers unless:

Products that are ordered in error, or that you changed your mind on, will be entitled to a credit note at our discretion.

Products that are faulty due to manufacturing process are entitled to a credit note under the manufacturers' warranty for a limited time specified in the manufacturer's terms and conditions (usually three months). If a product is credit noted due to manufacturing defects then you, the customer, is responsible for the return of the goods to such address as directed by the supplier.

We will then offer you a credit note on return including a maximum of £10 postage costs. All customers should use www.parcel2go.com for anything other than a small Jiffy Bag where the Post Office can be used. You can send up to 25kg for £10 with this service and that is all we will refund on return postage fees that are because of our error.

This does not affect your statutory rights.

Products that are damaged in transit to the customer CANNOT be refunded. If a product is damaged in transit the customer or recipient must NOT sign for the delivery. Instead the customer must refuse delivery by the courier and then contact us for further details. Please email us at if you have want to return your order.

 

Standard Returns

If you are not completely satisfied with your purchase, simply return the item or items to our supplier in their original condition* within 14 days of receipt. For all returns please contact us, and please see our returns and refunds policy for more information.

The product(s) must be returned to our supplier (contact us at modifiedperformanceltd@gmail.com on how to do this) in the same condition in which you received them, and at your own cost and risk. It is recommended that you as the customer use a recorded delivery option to ensure the parcel arrives back to our supplier. If this delivery option isn’t used and the item goes missing then you, the customer, will be held liable, and we will not be required to refund you.

Please note:

- The item is your responsibility until it reaches our supplier. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.
- The cost of returning the item to our supplier is your responsibility.

Re-stocking Fees

As a drop shipping company we incur a 10% re-stocking fee from our supplier for any returned items from you, the customer. If you the customer changes your mind and wishes to return the product(s), as long as you qualify for our suppliers returns and refund policy, the product(s) will be checked by our supplier once they receive them. If the product(s) is/are fit for re-sale once returned then you, the customer, will be deducted the 10% re-stocking fee from your refund or credit note, whichever our supplier offers. 

 

Faulty Items

If the goods are faulty upon delivery please contact modifiedperformanceltd@gmail.com quoting your order number, your name and address, details of the product and the reason for return, and whether you require a refund or a replacement. We will then advise on how to proceed with the return. You have 30 days from receipt of the faulty item to return it to our supplier. Please see our returns and refunds policy for more information.
